A Collin County judge dismissed a high-profile sexual assault lawsuit against Dallas Cowboys quarterback (QB) Dak Prescott on Wednesday and ordered a hearing to consider punishment for the accuser.
In her deliberation, Judge Angela Tucker stated that the lawsuit lacked merit and that the plaintiff’s claims of sexual assault and defamation were unfounded.
“The original lies by [the accuser], her team, and their recent failed attempt to sue him civilly are all just a continuation of their extortion plot against Dak,” Prescott’s attorney, Levi G. McCathern, said in a statement to WFAA. “These ploys distract from the trauma of legitimate sexual assault survivors and also undermine the progress that our society has made in supporting them.”
Prescott’s Sexual Assault Accusation
Earlier this year, a woman sued Prescott, accusing him of sexual assault and seeking millions of dollars in damages. The lawsuit alleged that the incident occurred in the parking lot of a Dallas strip club in 2017. She claimed that Prescott, along with two members of his entourage and other women, took her to a business in Plano, where Prescott allegedly exposed himself and used physical force to sexually assault her.
Prescott denied the accusations and filed an extortion lawsuit, claiming that the woman was attempting to extort him with false charges of sexual assault and demanded $100 million to remain silent. According to Prescott’s lawsuit, the woman and her attorney sent a letter detailing the alleged assault to his alma mater, Mississippi State, in January, which Prescott’s attorney received. They did this to bring attention to the allegations against Prescott, suggesting the use of underhanded tactics.
The Dallas police department conducted an extensive investigation into the sexual assault allegations but ultimately found no evidence to support the claims. According to a police source, the police closed the case due to insufficient evidence. However, while the woman’s sexual assault lawsuit against Prescott is now closed, his extortion lawsuit remains open. The judge has scheduled a hearing for mid-September to assess potential sanctions against the plaintiff and her legal team for ‘bringing frivolous claims.
Prescott has also vowed to donate any proceeds from the lawsuit against the woman to the Joyful Heart Foundation, an organization dedicated to combating sexual assault, domestic violence, and child abuse.
Prescott’s Career Highlights and Contract Update
Prescott, 30, begins his ninth season in the league this summer. Last season, the former Mississippi State standout threw for 4,516 yards and 36 touchdowns, leading the Cowboys to the playoffs for the third consecutive year and securing their second NFC East divisional title in three years. Prescott is entering the final year of his four-year, $160 million contract with the organization.
